These Terms of Use (“Terms”), apply to your use of the eSahayogi Mobile Application, Website, Products, Content, Features and platform (collectively, the “platform”).

By accepting these Terms or using the platform you are deemed to have entered into an agreement with us (eSahayogi).

Additional terms may apply to specific services.

Our privacy practices are described in the Privacy Policy.

 

1. Freedom for Sahayogis, Choice for Sewagrahis

Our business model

eSahayogi operates an online platform that connects users (Sewagrahis) with other users (Sahayogis) who provide services through the eSahayogi platform.

When a Sewagrahi requests a Sahayogis's service with their value proposition. Sahayogis who see the request can agree to the proposed price or make a counter offer.

The Sewagrahi is free to choose a Sahayogi from the list of Sahayogis willing to accept the service request. After the Sewagrahi confirms the work, there is a separate agreement between the Sahayogi and the Sewagrahi.

 

The Sewagrahi shall pay the Sahayogi the price agreed upon by both through the platform. This agreed price includes all charges (fees, taxes, etc.) associated with the service.

eSahayogi is in no way involved in transactions between Sahayogis and Sewagrahis.

 

eSahayogi Services Pvt. Ltd

eSahayogi Services Pvt. Ltd. is a technology company that does not itself provide any services through this platform. These services are provided by Sahayogis independent of the use of our platform. Any decision to offer or accept the services is an independent decision made in each user's sole discretion at the user's own risk. eSahayogi does not direct or control Sahayogis in their delivery of services.

Fees and Payments

eSahayogi may charge platform Fees to Sahayogis for using the platform. We may change the platform Fee amount from time to time. Your continued use of the platform will be deemed your acceptance of the updated fees.

The platform charges for each completed task. Your payments are recorded in your personal account and you can find the current amount of platform fees in your personal account.

If the Sewagrahi accepts the offer on the eSahayogi platform, a work contract is created between the Sahayogi and the Sewagrahi and a platform fee is charged for this work. If the task is not completed due to the Sewagrahi's reasons, the payment is refunded to your account. In such cases, you have to click on “Cancelled by Sewagrahi”. In such cases, refund may take up to 30 days.

In eSahayogi app, if the balance in the Sahayogi's account is less than the minimum balance, the Sahayogi should top up as soon as possible. The Sahayogi's access to the eSahayogi app will be limited until the minimum balance is met, during which the Sahayogi will not be able to view and communicate with the service requests of the Sewagrahis.

Sahayogis are themselves responsible for taxes related to services provided by Sahayogis through the platform.

eSahayogi may, from time to time, offer promotions, discounts, referral programs and loyalty programs (hereinafter - Offers) to any Sewagrahi or Sahayogi with various benefits.

Additional information regarding the Offers may be provided in notices within the Website or App or by any other means of communication as set forth in these Terms.

eSahayogi also reserves the right to withhold or deduct the bonus or other benefits received through the offers in case the receipt of the offer or bonus is by mistake, fraud, illegal means.

eSahayogi reserves the right to terminate, discontinue, modify or cancel any offers at any time in its sole discretion without notice to the User.

 

2. Your  eSahayogi Account

Account registration

To use the features of the platform, you must open an account with us. To register, you must be at least 18 years old. You must provide accurate information about yourself when opening an account.

We will ask you for information at the time of account opening to ensure your security and to verify your identity to comply with anti-money laundering, sanctions laws and regulations. We may ask you to update and verify your information from time to time.

We offer different types of accounts depending on whether you use the platform as a Sewagrahi or Sahayogi. To create an Sahayogi Account you must provide us with additional information and complete the verification process.

 

To maintain your account

You should update your details including mobile number immediately if they change.

You may not authorize others to use your account. You must maintain the security of access to your device and the confidentiality of your login information. You are responsible for all activities that occur through your account.

 

Account Termination

You can remove your account at any time. You can do this in the app settings or by contacting User Support (http://esahayogi.com/en/contacts/support). In some cases, we may be unable to remove your account or may retain certain information for legitimate purposes.

Accounts that have been inactive for more than 3 years may be removed. We have the right to terminate or close access to your account.

 

3. Your safety

The safety of eSahayogi users is our priority. We take reasonable steps to make the platform safe for our users. For example, we review documents before allowing all Sahayogis to provide services. If necessary, we may also ask the Sewagrahis for a government-issued identification certificate. 

Please ensure that the photographs of Sahayogis or Sewagrahis you see on the platform are the same ones you see in person. If you find that the Sahayogi providing you service is different from the picture in the eSahayogi app, please report it to ESahayogi and we will take necessary investigation and action.

We urge you to exercise caution when interacting with other users. You use and provide the services at your own risk.

Immediately report any suspected security threats to User Support (http://esahayogi.com/en/contacts/support) or use the "SOS Button".

The SOS button has two options:

- Allows you to call the police.

- Allows you to share your information with the number of your phone contacts.

We do our best to keep our app safe and convenient for you. Therefore, we constantly improve and modify the user verification system and platform.

 

4. Obligations of Sahayogis

When providing services as a Sahayogi you have the following responsibilities:

- You have valid licenses and all necessary permits to provide the services and you are physically fit to provide the services;

- you will not provide the services under the influence of fatigue, alcohol or drugs;

• you do not discriminate against Sewagrahis;
• you will not demand any additional payment beyond the price agreed with the Sewagrahi through the platform;
• you are responsible for paying all taxes associated with your services;
• at our request you will provide information regarding the service and your use of the platform;
• you shall not use the information obtained through the platform for any purpose unrelated to the use or provision of the services;
• you comply with all applicable laws regarding money laundering, anti-corruption, anti-trafficking and terrorist financing, prohibiting the use of child or forced labor. You will not facilitate, encourage or induce anyone to participate in such activities, which may be in violation of such laws.
• you will comply with eSahayogi policies applicable in your country.

5. Communications between Sahayogis and Sewagrahis

You must treat other eSahayogi users with respect. You may communicate with other users only for purposes related to the service. You must not share any unnecessary contact information. Communication should end when a service is complete. Subsequent communications may be viewed as harassment and may result in the suspension or termination of your account.

We provide users with the facility of communication on the platform through comments, in-app chat or in-app calls. We reserve the right to monitor and record your communications with other users on the platform to ensure compliance with these Terms.

While providing the service you may contact other users through the mobile number provided in the App interface. In this case the mobile charges set by your mobile carrier will apply.

 

6. Communications of eSahayogi

We may send you the following operational notifications:

• Updates about eSahayogi and the platform,
• Request for feedback,
• and marketing communications.

We may contact you via e-mail, SMS, phone, and push notifications.

For types of communications that require your consent, we will comply with local laws and give you the option to opt-out.

 

7. What you can't do on the platform

You must not use the platform to:

• any illegal act;
• any act that violates these Terms or any other platform rules and eSahayogi policies;
• use the platform for any purpose not intended by these Terms;
• transfer or sell your account, password or identity to any other party;
• impersonate or disguise your identity, use or attempt to use another user's account;
• soliciting others to engage in illegal or dangerous activities;
• stalking, threatening or harassing others;
• upload any false, inappropriate, infringing of anyone's rights (such as intellectual property, privacy or personality rights) or illegal content to the platform;
• attempt to undermine the operation or security of the platform, gain unauthorized access to the platform or its related systems or networks;
• extract any data or content from the platform;

 

8. eSahayogi’s Rights

We reserve the right to investigate any suspected violation of these Terms. In doing so, we are permitted to suspend your access to some or all features of the platform, acting reasonably and objectively based on the severity of the suspected violation.

We may temporarily or permanently suspend or terminate your account, or limit your access to the platform's features, in the following cases:

 

- on the basis that you have engaged in repeated violations of these Terms or other eSahayogi rules and policies;

- if we have objective grounds to believe that you are about to materially breach these Terms;

- if we are legally required to do so;

• In case of serious technical or security issues.

In the event that your account has already been terminated for violation of these Terms, we may suspend or close any such accounts if you use our platform again (for example, by opening another account).

If your account is mistakenly suspended or closed you can appeal via http://esahayogi.com/en/contacts/support.

 

9. Your content

You are responsible for the information, files and images (collectively, "Content") that you provide to the platform. You must ensure that your content does not violate the law or anyone else's rights. We are not responsible for users' content. We may remove or restrict access to any Content if we believe the Content violates these Terms, or is harmful to eSahayogi, our users or other third parties.

We do not own your content. By providing Content to the platform, you grant eSahayogi a permanent, irrevocable, worldwide, royalty-free, and non-exclusive license to use your Content for the purposes of operating, developing, and providing the platform, including to reproduce, display, and publicly communicate your Content.

 

10. Intellectual property

The content contained in the platform (such as designs, images, sounds, text, databases, computer codes, registered and unregistered trademarks and other similar items) is protected with the ownership of eSahayogi.

eSahayogi grants you limited temporary permission to:

(a) to access and use the platform on your personal device solely for the purpose of using the platform and;

(b) to access and view any content or materials made available through the platform solely for your personal, non-commercial use;

You may not allow yourself or any other party to:

(a) modify, reproduce etc. the platform;

(b) attempt to reverse engineer, decompile, disassemble or modify the source code of the platform to create a competing product or service and to create a product using similar ideas, features, functions, or graphics;

(c) frame, link or mirror any part of the platform to any other server or wireless or Internet-based device;

(d) post, distribute or reproduce any trademark or other material proprietary information associated with eSahayogi without eSahayogi's prior approval.

 

11. Indemnity

You agree to indemnify eSahayogi and its affiliates, subsidiaries and their officers, employees and agents against any claims, demands, losses, liabilities, and expenses that may arise from:

(a) your use of the platform or services;

(b) Your violation of any of these Terms, any existing law or regulation, or the rights of any third party (collectively, “Damage").

 

12. Liability

Liabilities of eSahayogi

To the maximum extent permitted by law, eSahayogi shall not be liable to you or anyone for any direct, indirect, punitive, pecuniary, future special, exemplary, incidental, consequential, or other damages of any kind (personal injury, emotional distress and data, loss of goods, revenue, profit, use or other economic benefit etc.).

 

Third Party Services

There is no joint venture, partnership, employment, or agency relationship between eSahayogi and any of our users. To the maximum extent permitted by law, eSahayogi is not responsible for the actions of any Sahayogi or Sewagrahi or any services. eSahayogi shall have no role in disputes or negotiations between eSahayogi platform users.

While other third party services are available on the platform, some third party services or content are accessible only by exiting the platform. Once you click on a link to access such services, you will be subject to the terms and privacy policy of that website, destination, or independent service provider, which may differ from eSahayogi’s. eSahayogi is under no obligation to inform you that you are subject to the terms and conditions (including privacy policies) of another website, destination. You use all links to third-party websites and advertisements at your own risk as these are not part of the platform and are not controlled by eSahayogi. In no event shall eSahayogi be responsible or liable for any products or services of such third-party providers.

 

13. Resolution of Disputes

These terms are governed by the laws of Nepal. If we have a dispute we will first try to resolve it amicably with you. All disputes or claims arising out of or relating to these Terms, their validity, breach, termination or nullity shall be resolved by applicable law.

 

14. Changes to the Terms or the platform

We may change these Terms or the platform from time to time. As we update the Terms, we will post their latest version on our App and Website. We will also give you reasonable notice of important changes that affect you.

If you want to continue using the platform after we make changes to the Terms or the platform, you will need to agree to the changes by continuing to use our platform. If you do not agree to such changes, you must stop using the platform.

 

15. General

We promise to provide you with the platform with due skill and care. However, we provide the platform "as available". This means that we make no representations, warranties, or guarantees as to the reliability, security, timeliness, quality, suitability, availability, accuracy or completeness of the platform.

Please keep the platform updated and make sure your device is compatible. We advise you to use the platform with a data plan with unlimited or very high data usage limits.

The platform may contain links to third party websites, advertisements, services, offers or other programs or activities, use of which is at your own risk. 

Nothing in these terms affects statutory rights. The laws applicable to you will always be fully protected by you.
